Parties; independent undertaking
This agreement is between the accepting performer and Charles Boswell, operator of MiVids, Texas, United States. You accept personally, voluntarily and with capacity to contract. You are an independent participant, not an employee, partner or agent of MiVids. This is an original MiVids agreement; it is not a Pornhub agreement and creates no affiliation with another platform. Age, identity and authenticity warranties
You represent that you are at least 18 and of legal majority, that every submitted identity document and statement is genuine, that the depicted person is you when you claim to be that person, and that you were an adult when each depiction was produced. You must provide your legal name, date of birth, aliases and required identity/age records through the private onboarding process. Public profile names may differ from legal names. False records, impersonation and accepting an agreement for another performer are material breaches. AgeVerif approval alone does not establish all production-record obligations.
Voluntary participation and specific consent
You confirm freedom from trafficking, coercion, threats, blackmail and material impairment. You may refuse a production or distribution request and contact support without retaliation. For each video, review the depiction, confirm that you appear in it and affirmatively consent to publication on the named creator’s listing. Account approval or this general agreement is not blanket consent to unidentified videos. All depicted performers must be declared, linked to their own verified accounts and independently approve. Each resale listing requires fresh consent; another creator’s approval cannot substitute for yours.
Production records and releases
Before production, the responsible producer must examine legally sufficient age/identity evidence and obtain the permissions and releases required by law. Maintain accurate records cross-referencing performers, aliases, production dates, titles/content IDs and distribution authority, including any applicable 18 U.S.C. 2257/2257A and 28 CFR Part 75 duties. Supply lawful evidence requested for review. Do not publish while records are incomplete or disputed. The uploader remains responsible for the legality, sufficiency, custody and retention of their production records. A later upload cannot retroactively establish a pre-production check.
Offers, fulfillment and support overrides
You must accurately state your prices, access scope and access-confirmation turnaround, which cannot exceed 48 hours. Verify funds in your own receiving account and promptly honor legitimate access requests. Do not misrepresent purchases as charitable donations. If a member reports non-delivery, Support may investigate the paid request and relevant evidence and provide the purchased scope of access after verification. You authorize that limited support adjustment, subject to all age, consent, moderation and content-availability restrictions. Your notification identifies the paid request number; internal support references and private investigative notes are not disclosed to you. This process does not relieve you of applicable refund, fulfillment, tax or consumer-law obligations or promise that MiVids will refund funds it does not hold. Payment-instruction changes are logged. You must give a truthful private reason when revoking membership access; it is visible to you and the administrator, while the member receives a generic revocation notice. Misuse may result in suspension. All support categories have a 24-hour target for response, which is not a promise of resolution within that time.
Limited platform license
For content you lawfully authorize for a specified approved listing, you grant MiVids a nonexclusive permission to host, transcode, secure, display and deliver that content and its chosen profile/promotional materials as necessary to operate the listing and service. You retain your underlying rights. This permission is limited by the listing’s consents, the original creator’s rights, applicable law and moderation restrictions; it does not authorize unrelated off-platform resale, third-party exploitation or training an unrelated AI model on your identity/content. You warrant that you have authority to grant the permissions you grant.
Prices, access and resale
You control permitted prices, profile choices and your own subscriber grants through your performer tools. Your member purchases and performer permissions share one account; each creator’s content access remains separately controlled. External payment arrangements are your responsibility and must comply with provider rules and law. No earnings, traffic, payment settlement or payout schedule is guaranteed by MiVids. Resale requires recorded original-creator permission and renewed consent from every depicted performer; no sublicensing is implied by a credit. Linked active performers may privately review videos in which they appear regardless of paid status, without obtaining rights to redistribute them.
Withdrawal, disputes and protection
You may withdraw a listing’s publication consent through your dashboard or request assistance. Fresh audience playback authorization will be blocked when withdrawal takes effect; previously issued short-lived delivery tokens may expire shortly afterward. We cannot recall third-party copies or guarantee prevention of recording. Report any consent dispute, exploitation, identity misuse or nonconsensual distribution immediately. We may hide content during review, preserve lawful evidence, notify affected parties when appropriate and comply with mandatory reporting/removal duties. No clause waives nonwaivable rights or permits continued unlawful distribution.
Moderation and unlawful material
The Acceptable Use Policy applies to every upload, message, profile and external link. Minors, trafficking, coercion, nonconsensual imagery, forged releases, abusive exploitation and unlawful material are strictly prohibited. The owner may review content, relevant messages, identity/consent records, disputes and reports for authorized safety/compliance purposes. Access to private identity records is restricted and logged. Do not retaliate against a reporter, solicit prohibited acts, omit performers or bypass publication holds. Removal, suspension, termination and legally required reports may follow violations.
Electronic acceptance; continuing obligations
To accept, open this agreement, scroll to the end, enter your legal name and affirmatively confirm your agreement. The service records the document version/hash, your account, signature name and acceptance time. Scrolling records an interface event and does not prove comprehension or replace an independently required signed production release. Read the document and contact support before accepting if you have questions. Material changes require renewed acceptance. Obligations concerning lawful records, confidentiality, accrued liabilities and preservation survive termination to the extent required by law. Texas and applicable United States federal law govern, subject to nonwaivable protections.
